An Indiana man is facing criminal charges after police say he fatally shot a man at a Texas Roadhouse.

Randy Godfrey, 34, was arrested and charged with murder, according to a news release from the Indianapolis Metropolitan Police Department.

Just before 9 p.m. Feb. 28, police were called to a report of a fight inside a restaurant. Before arriving, they got a call that a person had been shot.

Godfrey was at Texas Roadhouse having dinner with five people, including two children and 32-year-old Blaine Smith, the Indy Star reported.

While at the restaurant, a fight broke out between Godfrey and Smith, police said, according to the outlet. An off-duty IMPD officer was at the restaurant and intervened in the fight, police said.

The officer was holding Godfrey on the ground while Smith went outside, WISH reported, citing an affidavit. The officer identified herself as a cop to Godfrey, who responded by saying, “‘I don’t give a (expletive) if you’re a police officer,’ then pushed the officer off, saying, ‘I’m going to shoot that (expletives),’” court records said, according to the news outlet.

Godfrey followed Smith outside, then gunshots were heard, the Indy Star reported.

The off-duty officer ran outside toward the gunfire and held Godfrey at gunpoint until police arrived, authorities said.

“I am proud of our officer whose bravery and quick actions, even while off duty, led to the safe apprehension of this suspect,” IMPD Chief Chris Bailey said in the release. “This officer’s actions reflect the dedication and commitment of all our officers to protect, serve, and keep our community safe - on or off the clock.”

Smith was found with a gunshot wound and was taken to a hospital where he was pronounced dead, according to police.

McClatchy News reached out to Texas Roadhouse for comment March 4 but did not immediately hear back.
