Driver who killed 2 Horry highway workers shouldn’t have been behind the wheel: lawsuit

A truck driver was not medically fit before he got behind the wheel, crashing into and killing two state highway workers, according to a lawsuit.

Cecil Morgan, 35, from Aynor, and David Sibbick, 29, from Loris, died in the crash. They were working along U.S. Highway 501 outside of Conway on July 25.

Last week, the Sibbick and Morgan families each filed wrongful death lawsuits in Horry County court. The two suits are nearly identical and both name Ferguson Enterprises Inc., Ferguson Enterprises LLC and truck driver James Tyrone Williams as defendants.

The suits state two vehicles were stopped behind a SCDOT dump truck. Williams crashed into the two cars, then ran over the two workers, killing them.

Williams failed to reduce his speed, despite signs warning about the road work, the suits state.

Williams was also not medically qualified to drive based on industry standards and federal regulations, the suits contend. The filings stated that Williams has severe obesity, hypertension and possibly sleep apnea.

The filings also note that Williams did not do a pre-trip inspection that showed non-functioning breaks.

Ferguson’s recklessness allowed Williams to drive the vehicle despite his conditions, the suits state. The families also claimed Ferguson should have known the vehicle was not safe.

The victims’ families asked for an unspecified amount of damages.

Ferguson Director of Commutations and Public Relations Christine Dwyer expressed condolences for “those affected by this tragic accident,” but said the company could not comment on pending litigation.
