South Carolina HOA law languishes; look to Nevada plan

It seems that any HOA initiative for South Carolina is on hold, again. Maybe slowly changing the SC Nonprofit Corporation Act of 1994 is not a good starting point.

What if the approach changes, from the accountability of the POA/HOA boards and property managers to a state licensed agency instead?

How about an Office of Ombudsman for S.C.’s HOAs? Nevada has a very good HOA program (NRS 116) which has an Office of Ombudsman (NRS 116.525) that oversees the HOA communities in Nevada.

The office mediates, arbitrates and assists board members and residents in understanding and enforcing state and community guidelines with consequences i.e. fines and possibly jail time … something new for S.C. POA/HOAs.

Property managers would be state certified with continuing education requirements (NRS 116A.400)

The office would be funded by a minimal assessment to the residents of the HOAs — well worth the accountability factor for SC POA/HOA boards and property managers.
