Student falls from broken equipment at Myrtle Beach area school, suit claims
A Horry County Schools elementary student received a concussion after falling from playground equipment that was under construction, according to a lawsuit.
Heather Lee, the mother of the student, claims in the lawsuit that the child was allowed to play on the equipment at River Oaks Elementary, 700 Augusta Plantation Drive in the Myrtle Beach area, even though it was under construction and school employees were instructed by leadership to not allow students to enter the playground, the suit said. The playground area was not barricaded or roped off to limit student access, the suit said.
While “safety is a priority ... we cannot comment publicly or with specificity on pending litigation,” Horry County Schools district spokesperson Lisa Bourcier said by email.
The child suffered multiple injuries, including a concussion, and endured post-concussive symptoms after the incident on Sept. 22, 2025, the suit claims. Following the fall, the child’s parents were never contacted by school administration about their child’s injuries, the suit said.
The suit, filed on March 27, 2026, claims that the school and its staff were negligent in providing a safe environment while the student was in their care and left students unsupervised near the playground area that was under construction.
The plaintiff is asking for a jury trial.
