Man dies after run over in North Myrtle Beach hotel parking garage, suit claims
The father of a man who died after he was run over in a North Myrtle Beach parking garage is suing the hotel and the employee who hit him.
Patrick Kelly Kyler, the father of Declan Michael Kyler, filed the wrongful death lawsuit against North Beach Resort & Villas, Brittain Resorts & Hotel LLC and Delores Ellis.
A message left for Brittain Resorts was not returned by publication.
Ellis is accused of driving a vehicle in the parking garage in the course and scope of her employment with the hotel and Brittain Resorts.
The lawsuit said that Patrick Kyler and his son were changing a flat tire on the third level of the hotel parking garage at 9:30 a.m. on May 27, 2023, when Ellis was driving the vehicle, moving it from place to place. Ellis struck Declan Kyler, causing him to fall to the ground and become injured, the suit said.
The injuries ultimately caused his death, the suit said.
Kyler’s father is seeking damages by a jury trial for the negligence of the driver, who failed to keep a proper lookout, failing to observe the deceased and driving in an unreasonable and careless manner without thought for others, the suit said.
The lawsuit also accuses resort company and the hotel for being negligent in hiring and training, failing to review the driver’s driving history and the driver’s driving skill.
