Myrtle Beach area bar served ‘intoxicated’ man drinks, suit says. He then got behind wheel

A Myrtle Beach area bar and restaurant is being accused of serving an intoxicated customer who eventually left the restaurant and injured someone in an accident.

Michael Hunter Plusnick filed a lawsuit against Danny Lee’s Place, also listed as DL’s Sports Bar and Restaurant, 4501 Socastee Blvd., claiming that the bar should have known that James Currie Locklear was intoxicated, but continued to serve the man drinks, the lawsuit said.

Locklear is also named in the suit.

A person answering the phone at Danny Lee’s Place declined to comment. A phone number for Locklear could not be located.

The suit claims that on June 2, 2022, between 1:30 to 2:30 a.m., Locklear, also known as “Kirby,” was drinking at Danny Lee’s and had an excessive number of “intoxicating beverages” over the course of one hour.

Locklear then left the bar and got into his vehicle, which also had Plusnick as a passenger, and drove away. Locklear was speeding on Farrow Parkway, which caused the vehicle to “violently” strike a curb and then a city sign, the suit said.

Locklear ultimately lost control of the vehicle and struck a tree head on, the suit said.

The suit, filed March 19, 2025, said the bar violated state law by continuing to serve Locklear while he was already “visibly intoxicated” and presented an “unreasonable danger to the public.”

Plusnick received severe injuries, including blunt trauma to the head, a broken jaw that required surgery, concussion and spinal injuries, the suit said.

The bar violated state law, which prohibits selling alcohol to intoxicated persons, the suit said.

Locklear was negligent in driving his vehicle carelessly and while intoxicated, the suit said.

Plusnick is asking for damages for medical and related expenses, as well as lost income. Plusnick’s medical damages to date total $207,929.49 and will need future medical care, the suit said. He is asking for a jury trial.
