Man badly hurt at Myrtle Beach rooftop bar accuses it of being ‘dangerous’ spot, suit says

A Pennsylvania man is suing a Myrtle Beach rooftop bar after he claims he was injured during a nighttime “disturbance” on the property.

Daniel Palmieri was at RipTydz Oceanfront Grille and Rooftop Bar on Sept. 19, 2022, when he became involved in a disturbance that occurred between patrons at the bar, the lawsuit said. As a result, Palmieri received serious and permanent injuries, as well as permanent scarring, the suit said.

The suit names not only the bar, but also RipTydz Hospitality Group and Watson Family LTD Partnership.

A person answering the phone at RipTydz took a message not returned by publication. A message left at a number believed to be for Watson Family LTD Partnership was not immediately returned.

The lawsuit does not describe details of the disturbance, only that Palmieri was injured.

However, a Myrtle Beach Police report from that night describes a fight at RipTydz, 1210 N. Ocean Blvd. Officers responded at about 11:09 p.m. to a call of a fight at the bar. When officers arrived, they found two victims sitting down and receiving aid from the bar staff, according to the report.

One victim had a severe laceration on the back of his head, along with other injuries, and was falling in out of consciousness, the report said. The other victim was bleeding from his face.

The bar staff told officers that four men jumped the victims when they exited the elevator on the first floor. Video showed the men beating the victims until they were unconscious, including one breaking a bottle over a victim’s head, the report said.

The men then fled the scene, running southbound on the boardwalk, the report said.

Palmieri is accusing RipTydz of being negligent, including not screening patrons and having adequate security to help avoid incidents like the one involving him.

The lawsuit, filed on Feb. 4, 2025, accuses the bar and restaurant of being a “dangerous premises,” evidenced by the previous violent incidents requiring responses by law enforcement. Some of those incidents resulted in bodily injures and death, the suit said.

RipTydz was named in a lawsuit in 2023 by the family of a man who was shot and killed at the bar in 2018.

Palmieri is seeking damages, including medical costs, above $7,500.
