Man loses finger while dining at Dave & Buster’s in Myrtle Beach, lawsuit claims

A Myrtle Beach man claims he lost his finger while dining at Dave & Buster’s at Broadway at the Beach.

Usias J. Salaz is suing Dave and Buster’s of South Carolina LLC and the Myrtle Beach store’s manager, Steve Carr, for negligence.

A response from Dave & Buster’s corporate office said that the company does not comment on pending litigation. Carr was not working on Tuesday and an email sent to the restaurant was not immediately returned.

Salaz claims that on April 5, 2024, he was spending time with family and friends at the Myrtle Beach location, 1322 Celebrity Circle, when he shifted his chair, not realizing the screws to the stool’s cushion were loose, the suit said.

Salaz’s right ring finger became trapped in between the cushion and stool, severing his finger, the suit said.

The suit said that Salaz suffered pain and suffering, permanent impairment and disabilities, loss of income, medical bills and the inability to perform normal duties at work.

The lawsuit, filed Jan. 27, 2025, claims the malfunction of the chair violates safety standards and that the store should have taken measures to correct or remove the “dangerous and hazardous condition” through routine inspection.

The suit is asking for damages of more than $100,000, as well as punitive damages.
