North Myrtle Beach city manager avoids assault charges in wake of state probe
North Myrtle Beach’s top administrator will avoid any criminal charges stemming from an alleged confrontation with a local business owner that happened earlier in the year, 15th Circuit Solicitor Jimmy RIchardson told The Sun News Nov. 8.
His decision comes from the results of a S.C. Law Enforcement probe related to a May 10 incident between City Manager Mike Mahaney and Glass Bottom Kayak Tours co-owner Laura Weaver that fell short of proving reasonable doubt.
In May, the city’s police department asked SLED to investigate allegations that Mahaney put his hands on Weaver at a meeting in City Hall.
Richardson said in an Oct. 28 letter to SLED special agent Matthew Singleton there was “no question” Mahaney made contact with Weaver, but evidence was insufficient for prosecution.
“I can’t see any scenario where the State would be able to more forward with an assault and battery charge against Mahaney especially with our standard being beyond a reasonable doubt,” Richardson wrote. “If any further details emerge, I would be happy to look at them; however, at this time, we decline prosecution.”
