Recently, a video of a Florida DUI attorney’s suggestion to create a sign that says, “I remain silent. No searches. I want my lawyer.” has gone viral again. He says that when a driver approaches a police drunk-driving checkpoint, they don’t have to speak to the officers. He contends that commonly-used police drunk driving checkpoints violate drivers’ constitutional rights.

So this has prompted the question: Should this be allowed as a defense?

Yes, it should

Look, knowledge is power. Years are spent constructing bills and, ahem, educated lawmen spend plenty of time tweaking these bills to become law. Believe it or not, there are smarter lawyers than these lawmen we call politicians. If you find a loophole. like this one, you should be able to take advantage of it.

The more you know will get you more in life. If you figured a way to get around the law, get around it until they close the loophole.

No it shouldn’t

The law is in place to keep people safe, not to weasel your way around it.

It seems like every day I pick up the paper or read online, we’re making it harder and harder for police to do their jobs. When will we take responsibility for our actions? If I run from police, they may use force. If I don’t pay for something, I will get arrested. If I drink and drive, I can get charged with it.

Life is simple. Break the law, get in trouble. Cops should drive around with a sign that says, “Open the window. I am a person of authority, sworn to enforce the law. Failure to do so will result in your car being towed with you in it.” Let police do their jobs!
