There can be no debate on the Second Amendment. Its forum for “debate” is the amendment process. Either repeal the right, like the 18th Amendment, or strengthen it. Do you really want to force a debate? Then propose a resolution declaring the Second Amendment an individual, inalienable right.
The Second Amendment: “A well regulated Militia, being necessary to the security of a free state, the right of the people to keep and bear arms, shall not be infringed.” Accepted as fact, the only parts that can effectively be debated are what is a militia, what are arms.
Are the First, Third, Fourth, Fifth, Sixth, Seventh or Eighth amendments applied differently in the 50 states? No. How is it possible that I have a right to a 16-round magazine in South Carolina and I can be arrested for the same in New Jersey? That makes no sense.
New Jersey has no right to amend the Bill of Rights within its borders. California can’t ban free speech, Michigan cannot search homes and persons without a warrant.
